1. Acceptance of Terms

By accessing or using Flashcard Maker (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Who Can Use This App

✅ You must be at least 13 years old to use this App
✅ If you are under 18, you must have parental consent
✅ You represent that you have the legal capacity to enter into these Terms

2. Description of Service

Flashcard Maker is a mobile application that provides:

✅ Flashcard creation and management - Create unlimited flashcard decks with questions and answers
✅ Rich media support - Add images and audio to your flashcards
✅ Multiple study modes - Study with classic flip cards, multiple choice, typing, or matching games
✅ Spaced repetition - Smart algorithm shows cards at optimal intervals for maximum retention
✅ Progress tracking - Monitor your learning with detailed statistics and performance insights
✅ Cloud synchronization - Sync your flashcards and progress across multiple devices (optional)
✅ Premium subscriptions - Access to unlimited decks, cards, and advanced features
✅ Multi-language support - Study in your preferred language
✅ Light and dark theme options - Customize your study environment

What This App Is NOT:

❌ Not an educational institution or accredited learning provider
❌ Not a replacement for formal education or professional training
❌ Not responsible for the accuracy of user-created content

3. User Account and Responsibilities

Account Creation

You must provide accurate, current, and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately at umituz9999@gmail.com of any unauthorized use

Guest Mode

You may use the App in guest mode without creating an account
Guest mode data is stored locally on your device only
Guest mode does not support cloud synchronization or premium features
Guest mode data may be lost if you uninstall the app

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

✅ You MAY:

Use the App for personal learning and study purposes
Create and study your own flashcard decks
Share your flashcard decks with others (if feature is available)
Use the App for educational purposes

❌ You MAY NOT:

Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to the App or related systems
Interfere with or disrupt the App's functionality
Use automated tools (bots, scripts) to access the App
Reverse engineer, decompile, or disassemble the App
Remove or modify any copyright, trademark, or proprietary notices
Use the App to harass, abuse, or harm others
Impersonate any person or entity
Upload viruses, malware, or harmful code
Create content that violates intellectual property rights of others
Create content that is defamatory, obscene, or offensive

4. Intellectual Property Rights

Our Rights

All content, features, and functionality of the App, including but not limited to:

Text, graphics, logos, icons, images
Software, code, and design
Trademarks and service marks
User interface and user experience design

are owned by Flashcard Maker and are protected by international copyright, trademark, and other intellectual property laws.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the App for personal, non-commercial purposes
Download and use the App on your personal devices
Create and study flashcards for your personal learning

You do NOT have the right to:

❌ Republish, redistribute, or sell any App content
❌ Commercially exploit any part of the App
❌ Create derivative works based on the App
❌ Use the App name, logo, or branding without written permission

Your Content

When you create flashcard decks, cards, or other content:

You retain ownership of your content
You grant us a license to store and display your content for App functionality
You represent that you own or have rights to the content you provide
You are responsible for ensuring your content does not violate any third-party rights

5. Data and Privacy

Your privacy is important to us. Our collection and use of your data is governed by our Privacy Policy.

Key Points:

We collect minimal data (email, flashcard decks, study sessions, preferences)
We use Firebase and Supabase for secure data storage
We never sell your data
You can request data deletion at any time
Cloud sync is optional - you can disable it in settings

6. Premium Subscriptions

Subscription Plans

Flashcard Maker offers premium subscription plans:

Monthly Subscription - Billed monthly
Yearly Subscription - Billed annually

Subscription Terms

Subscriptions are managed through Apple App Store
Subscriptions automatically renew unless cancelled
You can cancel your subscription at any time through App Store settings
Cancellation takes effect at the end of the current billing period
No refunds are provided for unused portions of subscription periods

Premium Features

Premium subscriptions provide access to:

Unlimited flashcard decks
Unlimited flashcard cards
Advanced study modes
Cloud synchronization
Priority support

Free Tier Limitations

Free tier users have access to:

Limited number of flashcard decks
Limited number of flashcard cards per deck
Basic study modes
Local storage only (no cloud sync)

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Educational Warranty

❌ We make NO warranties about learning outcomes, test results, or educational effectiveness
❌ We do NOT guarantee that using the App will improve your grades or test scores
❌ The App is NOT a substitute for formal education or professional instruction

Technical Warranty

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

❌ Warranties of merchantability
❌ Fitness for a particular purpose
❌ Non-infringement
❌ Accuracy, reliability, or completeness of content
❌ Uninterrupted or error-free operation
❌ Security of data transmission
❌ Data loss prevention

We do not warrant that:

The App will meet your requirements
The App will be available at all times
Defects will be corrected
The App is free from viruses or harmful components
Your data will never be lost or corrupted

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No Liability for Damages

WE SHALL NOT BE LIABLE FOR ANY:

❌ Direct, indirect, incidental, special, or consequential damages
❌ Loss of profits, revenue, data, or use
❌ Personal injury or property damage
❌ Emotional distress or mental anguish
❌ Damages arising from your use or inability to use the App
❌ Loss of flashcard data or study progress
❌ Educational outcomes or test results

Maximum Liability

Our total liability to you for any claims shall not exceed the amount you paid to use the App (currently $0 for free users, or the amount paid for premium subscription).

Exceptions

Some jurisdictions do not allow limitations on warranties or liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Flashcard Maker, its owners, developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Any content you create or provide
Any actions you take using the App

10. Termination

By You

You may stop using the App at any time. To delete your account, email us at umituz9999@gmail.com.

By Us

We reserve the right to:

✅ Suspend or terminate your access immediately for Terms violations
✅ Discontinue the App at any time without notice
✅ Modify or change the App's features
✅ Remove content that violates these Terms

Upon termination:

Your right to use the App ceases immediately
We may delete your account and data (subject to legal requirements)
Sections of these Terms that should survive (Disclaimers, Liability, Indemnification) remain in effect

12. Changes to Terms

We may update these Terms from time to time to reflect:

Major changes: We will update the "Last Updated" date and may email registered users
Minor changes: We will update the "Last Updated" date at the top
Your responsibility: Check these Terms periodically for updates

Your Continued Use

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree with changes, stop using the App and delete your account.

13. Governing Law and Disputes

Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey, without regard to conflict of law provisions.

Dispute Resolution

Informal Resolution First:

We will attempt to resolve disputes within 30 days

Formal Disputes:

If informal resolution fails, disputes will be resolved through binding arbitration or small claims court
You agree to waive any right to a jury trial

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or collective proceeding.

14. Children's Use (COPPA)

Flashcard Maker is not intended for children under 13 years of age.

We do not knowingly collect data from children under 13
If we discover a child under 13 has provided data, we will delete it immediately

15. International Users

If you are using the App from outside Turkey, you agree to comply with all applicable local laws. We make no representation that the App is appropriate or available for use in all locations.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Flashcard Maker regarding the use of the App and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
