1. Acceptance of Terms

Welcome to Before Party. These Terms of Use ("Terms") govern your access to and use of the Before Party mobile application (the "App" or "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Before Party is a party planning application designed to help users:

Organize and manage parties and events (birthdays, weddings, corporate events, etc.)
Coordinate vendors and service providers
Track venues and locations
Manage budgets and expenses
Create and track bookings
Organize guest lists and RSVPs
Set reminders and notifications

Important: Before Party is a productivity and organizational tool. All data is stored locally on your device.

3. Eligibility

Age Requirements

You must be at least 13 years old to use Before Party.

Users under 18: If you are under 18, you may use the Service only with the involvement of a parent or guardian.
Users 13-17: Parental supervision is recommended.

No Account Required

Before Party operates without user accounts. All data is stored locally on your device.

4. User Responsibilities

By using Before Party, you agree to:

✅ Comply with all applicable laws and regulations
✅ Respect the intellectual property rights of others

4.2 Prohibited Activities

You agree NOT to:

You are responsible for all party data, vendor information, and content you create in the app
You own all content you create (it stays on YOUR device only)
We do not access, review, or moderate your content

5. Intellectual Property Rights

5.1 App Ownership

Before Party, including its design, features, code, and branding, is owned by Umit Uz and protected by:

Copyright laws
Trademark laws
International intellectual property treaties

5.2 Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

✅ Download and install Before Party
✅ Use the app for personal, non-commercial purposes
✅ Access all features on your device

You may NOT:

❌ Copy, modify, or create derivative works of the app
❌ Reverse engineer, decompile, or disassemble the app
❌ Sell, rent, lease, or redistribute the app
❌ Remove copyright notices or branding

5.3 Third-Party Open Source

Before Party uses open-source libraries:

React Native (MIT License)
Expo SDK (MIT License)
Other libraries (see app credits)

These libraries retain their original licenses.

6. Privacy and Data

6.1 Privacy Policy

Your use of Before Party is also governed by our Privacy Policy, which explains:

✅ We do NOT collect, transmit, or store your data on servers
✅ We do NOT use tracking or analytics
✅ You have full control over your data

6.2 Your Data Ownership

✅ Your data stays on your device
✅ We cannot access your data (it never leaves your device)
✅ Delete data by uninstalling the app

7. Service Availability

7.1 "As Is" Service

Before Party is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

7.2 No Guaranteed Uptime

While the app operates offline, we do not guarantee:

❌ Uninterrupted access
❌ Error-free operation
❌ Compatibility with all devices
❌ Freedom from bugs or crashes

7.3 Maintenance and Updates

We may:

✅ Release updates and new features
✅ Perform maintenance
✅ Modify or discontinue features
✅ Change the Service at any time

Updates are optional. You can continue using older versions (functionality may be limited).

8. Limitation of Liability

8.1 No Liability for Data Loss

Before Party stores all data locally on your device.

We are NOT liable for:

❌ Data loss due to device failure, loss, or theft
❌ Data loss from accidental deletion
❌ Data loss from app uninstallation
❌ Data loss from device updates or resets

Recommendation: Back up your device regularly.

8.2 No Liability for Party Planning Outcomes

We are NOT responsible for:

❌ Party planning decisions you make
❌ Vendor or venue performance
❌ Accuracy of information you enter
❌ Financial decisions related to your parties
❌ Scheduling conflicts or missed events

Before Party is a tool - you are responsible for your own party planning decisions.

8.3 Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Our total liability to you for any claim arising from your use of Before Party shall not exceed $0 USD (zero dollars).

We shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Personal injury or property damage
Emotional distress

9. Indemnification

You agree to indemnify and hold harmless Umit Uz, Before Party, and our affiliates from:

Claims arising from your use of the Service
Your violation of these Terms
Your violation of any laws or regulations
Content you create in the app
Your party planning activities

10. Termination

10.1 Your Right to Terminate

You may stop using Before Party at any time by:

✅ Deleting the app from your device
✅ Uninstalling the app (removes all data)

10.2 Our Right to Terminate

We reserve the right to:

❌ Discontinue the Service at any time
❌ Remove the app from app stores
❌ Stop providing updates

If we discontinue Before Party:

We will provide 30 days' notice (if possible)
Your downloaded app will continue to work (local functionality)
No refunds are required (the app is free)

11. Changes to These Terms

We may update these Terms from time to time. Changes will be effective when:

We update the "Last Updated" date at the top
We post the new Terms on this page
We display an in-app notice (for significant changes)

Continued use after changes constitutes acceptance.

If you don't agree to the new Terms, stop using the Service.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of:

United States of America
State of California

12.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

Informal Negotiation - Contact us first to resolve the issue
Mediation - If negotiation fails, we'll attempt mediation
Arbitration or Court - Final resolution in California courts

12.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid:

✅ That provision will be modified to reflect the parties' intent
✅ All other provisions remain in full effect

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Before Party.

These Terms supersede all prior agreements, discussions, or understandings.

15. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
