1. Acceptance of Terms

Welcome to SafeCheckIn!

By downloading, installing, accessing, or using the SafeCheckIn mobile application ("App", "Service", "Application"), you ("User", "You", "Your") agree to be bound by these Terms of Use ("Terms", "Agreement").

If you do not agree to these Terms, do not use SafeCheckIn.

2. Description of Service

What is SafeCheckIn?

SafeCheckIn is a privacy-first, offline-capable safety check-in application designed to help users:

Send instant safety check-ins to emergency contacts
Manage emergency contact information
Schedule automatic check-in reminders
Track check-in history with optional location data
Maintain complete privacy with local-only data storage

3. Eligibility

Age Requirements

General Use: Users must be at least 13 years old to use SafeCheckIn independently
Children Under 13: May use with parental/guardian consent and supervision
No Age Verification: We don't collect age data, but users affirm they meet age requirements

Geographic Availability

SafeCheckIn is available worldwide. Some features (GPS location) may vary based on device capabilities and local regulations.

4. License and Restrictions

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

✅ Download and install the App on your personal device(s)
✅ Use the App for personal, non-commercial purposes
✅ Access all features and functionality

Restrictions

You agree NOT to:

❌ Reverse engineer, decompile, or disassemble the App
❌ Copy, modify, or create derivative works from the App
❌ Sell, rent, lease, or sublicense the App
❌ Remove or alter any proprietary notices or labels
❌ Use the App for illegal purposes or violate any laws
❌ Distribute the App outside official app stores
❌ Circumvent security features or technical limitations
❌ Use automated tools to access or scrape the App
❌ Impersonate others or provide false information
❌ Interfere with the App's operation or servers (we have none)

5. User Responsibilities

Your Obligations

You are responsible for:

✅ Securing your device - Use passcodes, biometrics, and encryption
✅ Backing up your data - Use device backup systems (iCloud, Google Drive)
✅ Accurate contact information - Ensure emergency contacts are correct
✅ Compliance with laws - Follow all applicable local, state, and federal laws
✅ Device compatibility - Ensure your device meets minimum requirements

Data Responsibility

Because all data is stored locally on your device:

✅ You control your data - We have no access to it
✅ You manage backups - Use device backup features if desired
✅ You secure your device - Protect against unauthorized access
✅ You delete data - Uninstalling removes all app data

6. Privacy and Data

Privacy-First Design

SafeCheckIn is designed with privacy as the top priority:

✅ Local-only storage - All data on your device
✅ No servers - We don't operate backend infrastructure
✅ No accounts - No registration or authentication
✅ No tracking - No analytics, ads, or profiling
✅ Offline-first - Works without internet

Your Data

Ownership: You own all data you create in the App
Control: You have complete control over your data
Deletion: Uninstalling the App deletes all data permanently
No recovery: We cannot recover your data if lost

7. Location Services

GPS and Location Features

SafeCheckIn can optionally use your device's location services:

Location Usage

Purpose: Enhance check-ins with GPS coordinates and addresses
Storage: Stored locally on your device only
Sharing: Never transmitted to our servers
Accuracy: Depends on your device's GPS capabilities

Your Control

iOS: Settings → SafeCheckIn → Location → "While Using the App"
Android: Settings → Apps → SafeCheckIn → Permissions → Location
In-App: Graceful degradation if permission denied

8. Intellectual Property

Our Rights

SafeCheckIn and all related materials are owned by Umit Uz:

App Code: Protected by copyright
Design & UI: Proprietary visual design
Branding: "SafeCheckIn" name, logo, and trademarks
Content: All text, images, and media

Your Rights

✅ Personal use: You may use the App for personal purposes
✅ Screenshots: You may share screenshots for reviews or support
❌ Commercial use: You may not use the App commercially without permission

Third-Party Content

SafeCheckIn uses open-source libraries (React Native, Expo, etc.) governed by their respective licenses.

9. Disclaimers and Limitations

NOT A SUBSTITUTE FOR EMERGENCY SERVICES

⚠️ IMPORTANT - PLEASE READ CAREFULLY:

SafeCheckIn is NOT a substitute for:

❌ Emergency services (911, 112, etc.) - Call emergency services for actual emergencies
❌ Professional safety devices - Not a medical alert system or professional monitoring service
❌ Real-time tracking - Does not provide live location monitoring
❌ Guaranteed delivery - Cannot guarantee check-in delivery (no server backend)

Use Case

SafeCheckIn is designed for:

✅ Peace of mind - Informal check-ins with loved ones
✅ Personal safety awareness - Track your own safety status
✅ Communication tool - Share status with trusted contacts
✅ Record keeping - Personal history of check-ins

Limitations

Offline Operation: Features work locally; no server notifications
Manual Process: You must manually send check-ins
Device Dependent: Requires charged, functional device
No Monitoring: We do not monitor or respond to check-ins

"AS IS" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do NOT guarantee:

❌ Uninterrupted service - App may have bugs or downtime
❌ Error-free operation - Software may contain defects
❌ Specific results - No guarantee of safety outcomes
❌ Data preservation - Device issues may cause data loss
❌ Feature availability - Features may change or be removed

10. Limitation of Liability

No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We (Umit Uz, SafeCheckIn) are NOT liable for any damages arising from:

❌ Personal injury or death - App is not a safety device
❌ Property damage - Use at your own risk
❌ Data loss - Back up your data regularly
❌ Device malfunction - Not responsible for device issues
❌ Service interruption - App may have bugs or downtime
❌ Reliance on App - Your safety decisions are your responsibility
❌ Third-party actions - Not responsible for emergency contacts' actions
❌ Consequential damages - No liability for indirect losses

Maximum Liability

IF LIABILITY EXISTS (which we disclaim), our total liability is limited to the amount you paid for the App.

Since SafeCheckIn is FREE, our maximum liability is $0.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any laws or third-party rights
Your data or content

11. Termination

Your Right to Terminate

You may stop using SafeCheckIn at any time by:

✅ Uninstalling the App from your device
✅ No notice or account deletion required (no accounts exist)

Our Right to Terminate

We may:

✅ Discontinue the App at any time without notice
✅ Release updates that change functionality
✅ Remove the App from app stores

Note: Because there's no server backend or user accounts, we cannot "terminate" your access. You control the App on your device.

Effect of Termination

Upon termination:

✅ Your license to use the App ends
✅ All data on your device remains (until you delete it)
✅ We have no obligation to retain or provide your data (we don't have it)

12. Updates and Changes

App Updates

We may release updates to:

✅ Fix bugs and improve performance
✅ Add new features
✅ Enhance security
✅ Update for new OS versions
✅ Change or remove features

Updates are optional but recommended for best experience.

Changes to Terms

We may modify these Terms at any time:

Notice: Updated "Last Updated" date at the top
Acceptance: Continued use constitutes acceptance
Disagreement: Stop using the App if you disagree

13. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles.

Dispute Resolution

Step 1: Informal Resolution

Before filing any legal claim, you agree to contact us at umituz9999@gmail.com to attempt informal resolution.

Step 2: Binding Arbitration

If informal resolution fails, disputes shall be resolved through:

Arbitration: Binding arbitration under Turkish law
Location: Arbitration in Istanbul, Turkey
Language: Turkish or English
Costs: Each party bears their own costs

Step 3: Exceptions

The following may be brought in court:

Small claims court disputes (under jurisdictional limit)
Intellectual property disputes
Injunctive relief requests

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class-action lawsuits.

Jury Trial Waiver

You waive any right to a jury trial for disputes related to SafeCheckIn.

14. Miscellaneous

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You: May not assign these Terms without our consent
Us: May assign these Terms to any successor or affiliate

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SafeCheckIn.

No Third-Party Beneficiaries

These Terms are solely between you and us. No third parties have rights under these Terms.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, etc.).

Headings

Section headings are for convenience only and do not affect interpretation.

Language

These Terms are written in English. Translations may be provided for convenience but English version controls.

15. App Store Terms

Apple App Store

If you download SafeCheckIn from the Apple App Store:

Agreement: These Terms are between you and SafeCheckIn (not Apple)
Apple's Role: Apple has no obligation to provide support or maintenance
Compliance: You must comply with Apple's Terms of Service
Liability: Apple is not liable for any claims related to the App
Third-Party Beneficiary: Apple is a third-party beneficiary of these Terms

Google Play Store

If you download SafeCheckIn from Google Play Store:

Agreement: These Terms are between you and SafeCheckIn (not Google)
Google's Role: Google has no obligation to provide support or maintenance
Compliance: You must comply with Google's Terms of Service
Liability: Google is not liable for any claims related to the App

16. Export Control

SafeCheckIn may be subject to export control laws:

Compliance: You agree to comply with all applicable export laws
Restricted Territories: Do not use in sanctioned countries
No Export: Do not export or re-export the App in violation of laws

17. Accessibility

We strive to make SafeCheckIn accessible to users with disabilities:
