Welcome to Emergency ICE (In Case of Emergency). These Terms of Use ("Terms") govern your access to and use of the Emergency ICE mobile application and web services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Emergency ICE is an emergency information storage and organization tool designed to help users:

Store emergency contact information with quick-access calling
Organize medical information (blood type, allergies, medications, conditions)
Save insurance and primary doctor details
Organize important document information by category
Maintain critical information accessible offline

Important: Emergency ICE is NOT a medical device, NOT an emergency service, and is NOT intended for medical diagnosis or treatment. See Section 3 for full disclaimer.

3. Critical Disclaimers

Emergency ICE is designed exclusively as an emergency information storage and retrieval tool.

❌ This app does NOT diagnose, treat, cure, or prevent any medical condition
❌ This app does NOT provide medical advice or medical treatment
❌ This app does NOT automatically contact emergency services
❌ This app does NOT replace calling 911 or your local emergency number
❌ This app does NOT replace professional emergency services
❌ We make NO health claims or medical promises

Emergency Response Responsibility

In a medical emergency, ALWAYS contact your local emergency services FIRST (911 in US, 112 in EU, etc.)

By using this Service, you acknowledge that:

Emergency ICE is for storing and organizing emergency information only
You must contact professional emergency services in actual emergencies
You will not rely on this app as a substitute for emergency medical services
You are responsible for keeping your emergency information accurate and up-to-date
First responders may or may not access information stored in this app
We make no guarantees about information accessibility during emergencies

Lock Screen Access Disclaimer

While Emergency ICE aims to make emergency information accessible from your device lock screen:

⚠️ Lock screen access depends on your device settings and operating system
⚠️ We cannot guarantee first responders will access this information
⚠️ You must configure your device settings appropriately for lock screen display
⚠️ Emergency ICE is a supplemental tool, not a replacement for medical ID features provided by your device manufacturer

If you have health concerns, please consult a qualified healthcare provider.

4. Eligibility

Age Requirements

You must be at least 4 years old (with parental supervision) to use Emergency ICE.

If you are under 18, you represent that you have your parent or guardian's permission to use the Service
If you are a parent or guardian permitting a minor to use the Service, you agree to supervise their use and accept these Terms on their behalf
Parents/guardians are responsible for ensuring accuracy of emergency information for minors

No Account Required

Emergency ICE operates 100% offline with NO user accounts:

✅ No registration - Start using immediately
✅ No login - No passwords or credentials needed
✅ No personal info - No email, name, or contact details required from us
✅ Privacy-first - All data stays on your device locally

5. User Responsibilities

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

❌ Violate any applicable laws or regulations
❌ Infringe on the rights of others
❌ Use the Service to store information about others without their consent
❌ Store false or misleading emergency information
❌ Use the Service for any commercial purposes without our permission
❌ Reverse engineer, decompile, or disassemble any part of the Service

❌ Use the Service in any way that could damage or impair its functionality
❌ Rely on the Service as a replacement for emergency services

Data Accuracy Responsibility

You are solely responsible for:

✅ Keeping your emergency contact information accurate and up-to-date
✅ Verifying medical information (blood type, allergies, medications)
✅ Updating information when contacts change phone numbers
✅ Removing outdated medications or medical conditions
✅ Ensuring emergency contacts have consented to being listed
✅ Testing that contact phone numbers work correctly
✅ Reviewing and updating your information every 6 months

We are NOT responsible for:

❌ Inaccurate or outdated information you enter
❌ Consequences of storing incorrect medical information
❌ Emergency contacts not being reachable
❌ First responders not accessing your information

Device Security

Since all data is stored locally on your device, you are responsible for:

✅ Securing your device with a passcode/password
✅ Protecting your device from unauthorized physical access
✅ Backing up your emergency data if desired (using device backup)
✅ Understanding that uninstalling the app will delete all local emergency data
✅ Configuring lock screen access settings appropriately

6. Intellectual Property Rights

Our Content

All content, features, and functionality of the Service, including but not limited to:

Text, graphics, logos, icons
Software, code, and algorithms
Design, layout, and user interface
Trademarks and branding ("Emergency ICE" name and logo)

...are owned by Emergency ICE or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You own 100% of your content - emergency contacts, medical information, document details, and all data you create in the Service.

Since Emergency ICE operates entirely offline:

✅ Full ownership: You own all your emergency data
✅ Complete control: Edit, delete, or export your data anytime
✅ Local storage only: Your content stays on YOUR device
✅ No server uploads: We never receive, store, or access your content
✅ No licensing: You don't need to grant us any rights to your content

We will NOT:

❌ Access your contacts, medical info, or any user-generated content
❌ Store your content on servers (there are no servers!)
❌ Share your content with anyone
❌ Use your content for any purpose
❌ Claim any rights to your content

Your data is YOURS and YOURS ALONE.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy:

By using the Service, you consent to our Privacy Policy.

We collect NO personal data (no accounts, no emails, no tracking, no analytics)

You have 100% complete control over your data

Future Paid Features

We reserve the right to introduce paid features, premium tiers, or subscriptions in the future. If we do:

Pricing and terms will be clearly communicated in the app
Core emergency features will remain free
Existing users may receive grandfathered benefits
You may choose whether to subscribe

9. Service Availability

No Guarantee of Availability

We strive to provide reliable Service, but we do NOT guarantee:

Uninterrupted or error-free access
Specific uptime percentages (offline-first app)
Freedom from bugs or technical issues
Compatibility with all devices or operating systems
Lock screen access on all devices

Offline-First Design

Emergency ICE is designed to work 100% offline:

✅ Core functionality does not require internet
✅ Data stored locally on your device
✅ Works in airplane mode
⚠️ Some future features may require internet (clearly marked)

Maintenance and Updates

We may:

Perform app updates with new features or improvements
Fix bugs or security vulnerabilities
Update the Service to comply with platform requirements
Add new emergency information categories

We will make reasonable efforts to notify users of important updates.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

General Limitations

The Service is provided "AS IS" and "AS AVAILABLE"
We make NO WARRANTIES, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement
We shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid us in the past 12 months (currently $0)

Emergency-Specific Limitations

We are NOT liable for:

❌ Inability to contact emergency services through the app (always call 911 directly)
❌ First responders not accessing your emergency information
❌ Inaccurate medical information you entered
❌ Outdated contact information
❌ Emergency contacts not answering calls
❌ Medical outcomes resulting from information stored in the app
❌ Device failure preventing access to emergency information
❌ Lock screen access not working on your device
❌ Data loss from device failure, uninstallation, or user error

You use the Service at your own risk. Always call professional emergency services first.

11. Indemnification

You agree to indemnify, defend, and hold harmless Emergency ICE, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any content or information you store in the app
Inaccurate or outdated emergency information
Any emergency situations where the Service was or was not used
Claims by emergency contacts listed in your app

12. Termination

Your Right to Terminate

You may stop using the Service at any time. Simply uninstall the app to remove all local data from your device.

Our Right to Terminate

Since the app operates offline with no user accounts, we cannot remotely terminate your access. However, we reserve the right to:

Remove the app from app stores if Terms are violated on a large scale
Discontinue development or support of the Service
Sunset the Service with reasonable notice

Effect of Termination

Upon termination:

Your right to access the Service ceases immediately
All local emergency data remains on your device until you uninstall the app
Your responsibility to contact emergency services directly remains unchanged
These Terms survive termination where applicable (e.g., liability limitations)

13. Changes to Terms

How We Update

We may modify these Terms at any time. When we do:

We will update the "Last Updated" date at the top of this page
Major changes may be announced in the app
Your responsibility: Check this page periodically for updates

Your Acceptance

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of United States, without regard to conflict of law principles.

Dispute Resolution

Informal Resolution: Before filing any claim, you agree to contact us at umituz9999@gmail.com to attempt to resolve the dispute informally.

Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

Exceptions

The following may be brought in court:

Small claims court disputes
Intellectual property disputes
Injunctive relief requests

15. Miscellaneous

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Emergency ICE regarding the Service.

16. Additional Disclaimers

No Guarantees

We do NOT guarantee:

That emergency information will be accessible during emergencies
That first responders will view your emergency information
That lock screen access will work on all devices
That emergency contacts will answer calls
That medical information will be accurate (you are responsible for accuracy)
That the app will work during device failure or low battery

Third-Party Services

Emergency ICE integrates with device features (phone dialer, lock screen) but:

⚠️ We do not control third-party services or device operating systems
⚠️ We are not responsible for device manufacturer lock screen functionality
⚠️ Phone calls depend on cellular network availability

International Use

If using Emergency ICE outside the United States:

You are responsible for knowing your local emergency service number
Do NOT rely on "911" references - use your country's emergency number
Medical and legal systems vary by country - consult local professionals
Some features may not work identically across all countries

17. Emergency ICE-Specific Terms

Medical Information Disclaimer

You acknowledge medical information storage is for informational purposes only
Medical information does NOT replace medical ID features on your device (e.g., Apple Medical ID)
You should ALSO use your device's built-in medical ID feature when available
We recommend redundancy - use multiple methods to store emergency info

Emergency Contact Consent

By adding emergency contacts, you represent that:

You have permission to list these individuals as emergency contacts
They are aware they may be contacted in an emergency
Their contact information is current and accurate
You will notify them if you remove them from your emergency contacts

Document Storage

Emergency ICE allows storing information about important documents, NOT full document files:

✅ Store document names, numbers, expiration dates
✅ Store insurance policy details
❌ Do NOT store full document scans or sensitive data beyond what's necessary
❌ Do NOT store passwords, PINs, or full SSN
⚠️ Information is NOT encrypted beyond device-level security

Export and Sharing

If Emergency ICE offers export features:

You are responsible for securing exported data
Exported files may contain sensitive medical and contact information
Do not share exports through unsecured channels
Delete exports after use

18. Apple App Store and Google Play Terms

If you download Emergency ICE from Apple App Store or Google Play:

You also agree to the applicable app store's terms of service
In-app purchases (if any) are subject to app store refund policies
App store providers are not parties to these Terms
App store providers have no obligation to provide support for the Service

19. Open Source Notices

Emergency ICE uses open-source software libraries. Licenses and attributions are available in the app's "About" section and comply with:

MIT License
Apache 2.0 License
Other permissive open-source licenses

20. Final Acknowledgments

By using Emergency ICE, you acknowledge and agree that:
