1. Acceptance of Terms

By downloading, installing, or using Merry Christmas: Noelio ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Merry Christmas: Noelio provides holiday-themed entertainment, including:

  • Christmas countdown timer.
  • Advent calendar activities.
  • Wish list management.
  • AI-Powered Santa Photos: A feature that transforms user-uploaded photos into festive Santa-themed images using Artificial Intelligence.

3. Account Registration

To access certain features (like cloud sync or AI generation), you may need to sign in using a third-party provider (Google or Apple).

  • You agree to provide accurate information.
  • You are responsible for maintaining the security of your device and account.

4. User Content and Conduct

User Content

"User Content" refers to any text, images (photos), or other material you upload or create in the App.

  • Ownership: You retain ownership of your User Content.
  • License: By uploading User Content (specifically for AI features), you grant us a worldwide, non-exclusive, royalty-free license to use, process, and modify that content solely for the purpose of providing the App's features (e.g., generating the Santa image).

Prohibited Conduct

You agree NOT to upload or generate content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful.
  • Depicts sexual violence or non-consensual sexual content.
  • Infringes on the intellectual property rights of others.
  • Contains malware or viruses.

We reserve the right to remove any User Content and terminate accounts that violate these Terms.

5. AI Features Disclaimer

The App uses Artificial Intelligence (Google Gemini) to generate images ("Generative Content").

  • No Guarantee: AI generation is unpredictable. We cannot guarantee that the generated images will be perfect, accurate, or meet your specific expectations.
  • As-Is: The AI features are provided "AS IS". Occasionally, AI may produce artifacts or distortions.
  • Responsibility: You are responsible for the photos you upload and the consequences of sharing the generated results.

6. Medical and Wellness Disclaimer

For Entertainment Purposes Only. The App is designed for holiday entertainment. It is not a medical device and should not be used to diagnose or treat any condition.

7. Intellectual Property

The App (excluding User Content), including its original code, design, animations, and "Noelio" branding, is the property of UmitUZ App Factory and is protected by copyright laws.

8. Third-Party Services

The App integrates with third-party services (Firebase, Google Gemini, Apple). Your use of the App is also subject to the terms and privacy policies of these third-party providers.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Merry Christmas: Noelio shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App or any AI-generated content.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes updates within the App or on our website. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

12. Indemnification

You agree to defend, indemnify, and hold harmless Merry Christmas: Noelio and its developers from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights (e.g., uploading a photo you do not own).

13. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
  • Jurisdiction: You agree to submit to the personal jurisdiction of the courts located in Turkey for any actions for which we retain the right to seek injunctive or other equitable relief.
  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
